So retrogamingconsolesinc.com has trademarked both Retropie and Emulation station

Post by Pirate » Wed May 24, 2017 4:41 pm

Hello everyone on March 18, 2016 retrogamingconsolesinc.com filed the trademark in the states for both Retropie and Emulation Station, both being a open source ever since the project started.

On December 27, 2016 they were granted the rights to RETROPIE
and on April 18, 2017 they were granted the rights to EMULATION STATION

What that means is that some random company now has the rights to both open source intelects meaning they can take anything down related to retropie this is a big deal and we should spread awareness.

This is the website of the people who now had the rights of retropie

RETRO GAMING CONSOLES INC. (DELAWARE CORPORATION)
28 OLD RUDNICK LANE
DOVER, DE 19901

retropie.org.uk are aware of this whole situation and they are asking for legal help on this matter.

I believe as of late the retropie team has taken a handle of this situation and there legal team is in the process of trademarking their brand. This guy has been shunned by the community and I believe no longer sells on eBay.

@HoolyHoo My ebay post was taken down today thanks to them. I've checked and the Trademark for both Emulation station and Retropie still belongs to RETRO GAMING CONSOLES INC.

Your post was probably taken down due to the actions of the Retropie team with Ebay with that seller. If your sales mentioned Retropie it might have been flagged. See this post from Buzz from the Retropie forums, creator of retropie.

Do you also notice no mention of RetroPie or EmulationStation in his website?

@HoolyHoo I guess my posting got caught in the crossfire, don't get me wrong I'm completely fine if Retropie took down my posting, but I wouldn't be happy if some random website decided to take down my posting because they wanted to be the ones making money.

I think it wasn't the Retropie team directly that took down your post. That guy did exactly what you said and he was having eBay taking down all sales with mentions of Retropie because he did file for trademark. Sneaky way to eliminate competition for his sales and pretty slimy. Anyway I'm sure eBay hasn't updated anything and is still taking down post under those orders. I was just pointing out that the Retropie team has been able to rectify the situation and this guy has changed his tune now with no mentions of Retropie or ES on his website.

I think you'll still be able to sell your product by saying something like "loaded with popular Raspberry Pi emulation software." Hopefully people will be able to put 2 and 2 together.

I know it was mentioned in an earlier post but I saw on their page that they're seeking legal guidance. It's really slimy what people do to each other over freeware. This is why we can't have nice things.

"R3tro0 Pi3" and "3mulat10n $tat10n"?
Am I understanding all of this right?
There was one group that swept the trademark out from under everyone by taking the open source software and claiming it as their own (retrogamingconsolesinc).
The Retropie team that was seeking legal help was able to obtain the trademark. They will continue letting it be open source like it has been now that they have the trademark?
Is that about right?
This is why we can't have nice things... Damn capitalism.
